Maximum Liability Cap

In no event shall our total aggregate liability to you for all damages, losses, and causes of action exceed the amount you paid to PixelCraft for services during the twelve months immediately preceding the event giving rise to liability.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Force Majeure

PixelCraft shall not be liable for any failure or delay in performance of our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, or extreme weather events
  • War, terrorism, civil unrest, or government actions
  • Pandemics, epidemics, or public health emergencies
  • Labor disputes, strikes, or lockouts
  • Telecommunications or internet service failures
  • Power outages or utility failures

During force majeure events, our obligations will be suspended for the duration of the event. We will make reasonable efforts to resume normal operations as soon as practicable.

Dispute Resolution

Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us to attempt to resolve any disputes or claims informally. We will make good faith efforts to resolve disputes through direct communication within thirty days.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Tokyo.

Jurisdiction and Venue

You irrevocably consent to the exclusive jurisdiction and venue of the courts located in Tokyo, for any disputes arising from or relating to these Terms and Conditions or your use of our services.
